Service Level Agreement



This Service Level Agreement applies to the ChainHost website located at www.ChainHost.com, and all associated sites linked to www.ChainHost.com by ChainHost, its subsidiaries and affiliates (those sites, the “Site”). The Site is owned by ChainHost (“ChainHost”). The Service Level Agreement also incorporates by reference the Terms of Use, the Privacy Policy and the Fees and Credit Policy also available at the Site (that Service Level Agreement, the “SLA”). BY USING THE SITE, YOU AGREE TO THE SERVICE LEVEL AGREEMENT. IF YOU DISAGREE WITH THE SERVICE LEVEL AGREEMENT, DO NOT USE THIS SITE.

ChainHost reserves the right, at its sole discretion, to change, modify, add or remove portions of this Service Level Agreement, at any time. You are responsible for periodically reviewing the Service Level Agreement for changes. By continuing to use the Site, you accept any changes at the time they are implemented.

Application of SLAs

The SLAs provide you with an understanding of your rights and remedies related to your use of the network infrastructure of the Site, as will be defined below.

Site Availability

The Site desires to make the network available to you free of network outages 99.9% of the time.

Site Latency

Latency is the average time required for round-trip packet transfers between Selected POPs on the selected portions of the Site’s network during a calendar month, as measured by the Site. The Site's goal is to keep Latency on the network to (i) 90 milliseconds or less for the North American Network, (ii) 120 ms or less for the Trans-Atlantic Network and (iii) 200 ms or less for the Trans-Pacific Network.

Site Packet Loss

The Site strives to keep Packet Loss on the network to 0.5% or less.

Failure to Meet SLAs

Packet Loss means the average percentage of IP packets transmitted between Selected POPs during a calendar month which are not successfully delivered, as measured by the Site. The Site’s failure to meet SLAs as described above will lead to a prorated credit to your account based on the failed SLA and your current monthly package rate.

Exceptions

The Site is not liable for server downtime or data loss in any circumstance outside the control of the Site and not caused by the direct negligence of the Site.

Violations

Please report any violation of this Service Level Agreement to ChainHost.
